Somewhere right now, an engineer at a small defense sub is pasting an ITAR-stamped drawing into a chatbot to speed up a quote.

A Copilot is indexing a shared folder full of controlled technical data.
And nobody in the building knows that a deemed export may have just occurred.

Under ITAR, a non-U.S. person accessing controlled data is an export — even inside the United States. AI tools have created entirely new pathways for that access to happen without anyone intending it.

The companies most at risk are the ones with the fewest resources: 10–50 person shops, one IT person, a folder of ITAR-stamped drawings from a prime, and no compliance infrastructure to catch it.

A National Stock Number follows an item through the entire federal supply chain: procurement, logistics, maintenance, disposition.

If the commodity classification behind that NSN is wrong, the error doesn't stay in one place. It travels.

Two things government contractors and suppliers should check:
Has the item been reviewed for ITAR or EAR classification, or just cataloged?

Has the regulatory landscape changed since the item was first classified? (ITAR-to-EAR migration, new controls, jurisdiction shifts.)

China issued its first blocking order on May 2.

With China's blocking order active, cross-border businesses face conflicting compliance demands. The strategy is not choosing which law to break, it is structuring operational firewalls and documenting good-faith compliance effort.

The practical advice: don't assume your Chinese operations can follow U.S. headquarters policy. The legal conflict may require separate compliance frameworks and documentation of good-faith effort matters to both regulators.

Country of origin isn't just a customs question.

It determines your duty rate but also your sanctions exposure, your export-control jurisdiction, and your eligibility for government contracts.

A product manufactured in China, assembled in Vietnam, and shipped from Singapore may still have a Chinese origin. And if it contains U.S.-origin controlled content above de minimis thresholds, it may be subject to U.S. re-export controls regardless.

The companies that get this wrong aren't making exotic mistakes. They're assuming the last country of shipment is the country of origin. It isn't.
