We have clients report to us that their employee has declared that they are on FMLA leave. Not so fast!!!! The employer must qualify to offer this leave. The employee must qualify for the leave themselves. There must be notice when practicable AND there is a process.

Hot off the press!!!!! In the case of Bradsbery v. Vicar Operating, Inc. the judge determined that employees can waive meal breaks for shifts that are 6 hours of less once (not annually, quarterly or every time the break is waived) as long as the waiver is in writing and mutually revocable at any time!
