Could labour hire licensing be coming to NSW?
A NSW parliamentary inquiry into modern slavery risks faced by temporary migrant workers has recommended introducing a state labour hire licensing scheme.
The NSW Government has said its preference remains a nationally harmonised model. However, it is also examining the possibility of introducing a NSW scheme and reviewing models already operating in other states.
No decision has yet been made. However, financial services organisations using labour hire providers or contingent workers should watch the development closely.
A new model could affect provider selection, due diligence, contractual requirements, record keeping and ongoing compliance.
For employers, the practical question may not simply be whether a provider is licensed. It may also be what additional responsibility sits with the organisation engaging that provider.
