"We're waiting until the new Code is finalised before making any changes."

We understand the thinking.

The consultation is still open, and the final version hasn't been published yet.

But the draft ACAS Code already gives employers a useful indication of where expectations may be heading. Greater emphasis on resolving issues early, having meaningful conversations before problems escalate, and supporting managers to handle concerns confidently.

Alongside that, from 1 October 2026, most Employment Tribunal claim time limits will increase from three months to six months.

Taken together, it feels like a continued shift towards proactive employee relations rather than reactive processes.

Perhaps the more important question isn't whether the law changes.

It's whether we're creating workplaces where issues are addressed early enough that they don't become formal disputes in the first place.

The organisations that do this well are often the ones investing in manager capability, clear communication and early intervention long before legislation requires it.

Whatever happens following the consultation, employers are likely to benefit from reviewing how concerns are raised, managed and resolved across their organisation.
